Welcome to Tina Caron Portraits & Fine Art. By booking a session or purchasing services through this website or in person, you agree to the following Terms and Conditions. Please read them carefully.


1. Services Provided

Tina Caron Portraits & Fine Art offers photographic and fine art portrait services including but not limited to:

Headshots & Personal Branding

ᐧ Maternity & Newborn

ᐧ Individual, Couples & Family Portraits

Painted Portraits

ᐧ Dreamweaver Creative Storytelling Imagery

All services are by appointment and subject to availability.



2. Booking & Payment


All sessions require a non-refundable booking retainer to secure your session date and time on the studio calendar. Once a session is booked, that date is reserved exclusively for you, and no other appointments will be accepted.


Images are not included in the booking retainer unless explicitly stated at the time of booking. The specific inclusions of each retainer may vary based on the type of session booked. Final payment for services and products is due as outlined during the consultation or as specified in your booking documents.


Accepted Payment Methods


The studio accepts the following forms of payment:

ᐧ Major credit cards (Visa, Mastercard, Discover, Amex)

ᐧ Cash

ᐧ Check

ᐧ Bank transfer via Zelle

The studio reserves the right to verify availability of funds prior to services or order fulfillment. Checks returned for insufficient funds will incur a $50 returned check fee, and future payments must be made via certified funds — credit card, cash, or Zelle only. Orders or services will not proceed until the full balance, including any fees, is paid in full.

Please note: We do not accept PayPal, Venmo, or any peer-to-peer payment apps. We do not offer point-of-sale financing services such as AfterPay, Klarna, or similar platforms.

Booking retainers that include spending credit:

Spending credit included in your booking retainer serves as mutual commitment to the agreed scope of the session by both the client and the studio. Spending credit may not directly correlate to any specific product or product combination.Unused spending credit will not be refunded.




3. Cancellation & Rescheduling


Clients may reschedule one time within 3 business days after paying a booking retainer with no penalty.


After the 3-day window: Any rescheduling request will incur a reschedule fee equal to the original booking retainer paid, or $250, whichever is greater. Any inclusions from the original retainer will still be honored with your final order, in addition to those associated with the reschedule fee. Once any appointments related to the final booking (e.g., In-Home Style & Concept Consultation) have taken place, it is considered that the studio has begun work on your session.


Cancellations:

Booking retainers are non-refundable. Cancellations may be rebooked within 3 months of the original session date by paying the equivalent current booking retainer in effect at that time to retain the original inclusions. Cancellations not rebooked within 3 months are forfeited entirely.


Important Notes:

Reschedules and rebookings are subject to studio availability. The studio is not obligated to offer special accommodations or guarantee specific dates. Late arrivals may result in reduced or cancelled services.

Tardiness and No-Show:

Tardiness impacts the studio's ability to fully provide the expected service, and negatively impacts the onward schedule of our service partners, studio staff, and other clients. The studio is not obligated to extend any session end time to accommodate late arrivals, and reserves the right to reduce or fully cancel the services previously scheduled.

Clients who arrive 30% or more past their scheduled session start time may result in full cancellation. No-shows for any session-related appointment (including consultations or viewings) will forfeit all monies paid and will not be permitted to rebook services in the future.


Mutual Fit & Consultation Review:


If, during the in-person consultation, either the client or the studio determines that the session is not a good mutual fit, the booking may be cancelled

without prejudice. In such cases, the studio is not obligated to return the booking retainer. However, the retainer may be applied to a future session to be completed within one year of the original booking date. At the studio’s discretion—based on proximity to the scheduled portrait date and mutual agreement not to proceed now or in the future—the spending credit portion of the booking retainer may be refunded in whole or in part.



4. Artistic Style & Editing

By booking a session, the client acknowledges familiarity with the studio’s artistic style and creative direction.

While we are happy to review images provided as inspiration, we do not guarantee exact recreations of any image presented. Requests for settings, props, wardrobe, or styles that significantly diverge from our portfolio may be declined. The studio is not obligated to purchase or rent specific backdrops, wardrobe, or props unless such items have been explicitly negotiated and agreed upon in the booking agreement.


Retouching Policy:


Standard retouching is applied to all purchased images at a level appropriate for the intended viewing size of the final printed product.


Please note: Zooming into digital files at 100% (1:1) or higher may reveal perceived imperfections that are not retouched, as these will not be visible at the standard viewing distance of the final artwork.


Standard retouching includes:

ᐧ Blemish removal (temporary marks expected to clear within two weeks)

ᐧ Light skin softening and wrinkle reduction

ᐧ Hair smoothing

ᐧ Gentle teeth whitening

ᐧ Eye brightening

ᐧ Removing glasses glare

ᐧ Evening skin tone

ᐧ Minimal contouring based on posing for a flattering appearance

The studio is committed to presenting clients as their best, most authentic selves and reserves the right to decline retouching requests that significantly alter facial features, structure, or body shape beyond subtle enhancements.


Wall Art images are treated with Master Art Retouching, appropriate to the larger scale of the final printed piece.


Extensive retouching (which incurs additional fees per image) includes but is not limited to:

ᐧ Hair root touch-ups

ᐧ Nail polish color changes

ᐧ Deep wrinkle removal

ᐧ De-wrinkling or color changes of clothing

ᐧ Head/body/person swaps or composite imagery

ᐧ Dental corrections and braces/appliance removal

ᐧ Background alterations (unless previously agreed upon)

ᐧ Removal of tattoos or other permanent features

ᐧ Significant body modification

ᐧ Repeated requests for changes outside standard retouching scope

ᐧ Additional retouching requests beyond the first allowed revision following digital file delivery

All editing decisions are made at the discretion of the artist, unless otherwise agreed upon in writing.


Client Review & Approval:


All purchased images will receive retouching and will be delivered digitally for client approval before any printed product production. One round of minor retouching adjustments is included and must fall within the size-appropriate limits defined above.


5. Ordering & Delivery


All images are selected and purchased during an in-person ordering appointment. Online galleries are not provided for image selection in any circumstance.

One ordering appointment is included with your confirmed booking. All final and/or financial decision makers are expected to be present at this appointment. Additional ordering appointments will incur a booking fee equal to the price of one individual image according to the session type booked. This fee is non-refundable and will be applied to your final order.


For headshot sessions, image review and selection take place immediately following the session during the same appointment. For all other session types, a separate in-person ordering appointment will be scheduled.

Payment for your final order is due in full at the ordering appointment. The studio does not offer post-purchase payment plans. However, you may choose to make pre-paid installments ahead of your portrait session.

Orders must be placed and paid in full within 30 days of your session date. Sessions with incomplete orders after this period will forfeit any spending credit included with their session fee. Any exceptions to the 30 day ordering window must be negotiated with the studio prior to the execution of the portrait session.

At the ordering appointment, images will be presented unedited.

Retouching and final digital delivery of purchased images carries 7–14 days turnaround. Printed products are sent to production within one week of final digital delivery. Turnaround time for print products varies by item type; all tangible physical items in your order will be delivered in a single Delivery and Installation Appointment.

No images will be retouched or delivered in any form, and no products will be sent to production, until the order is completed and paid in full.



6. Product Orders

Clients are not obligated to a pre-defined purchasing minimum beyond any spending credit included in their booking retainer, nor are there bundled packages to choose from or adhere to.

Images are purchased individually, with pricing advantages applied at certain increasing quantities (referred to as Image Collections). The client is free to purchase any number of images they desire.

Unpurchased images created in a session will not be delivered in digital format. The studio is not obligated to retain or maintain unpurchased image files. The client may request the studio retain files by paying a $500 archival fee, after which the files will be maintained for no less than 6 months. This fee will be applied toward any additional order made in the 6 month archival window. After the archival window expires, the archive fee no longer applies to any purchase and any files in the archive are subject to deletion.

Standard image purchases include a 5x7 print in an 8x10 mat. Images may also be purchased with accompanying products such as folio boxes, albums, and custom framed wall art.


Any image purchased in any form includes the singular matching digital file.

Unedited or RAW files will not be released, as these are considered unfinished products and not representative of the high standards set by the studio for final artwork.

All artwork and image orders are custom and final sale.

In accordance with Texas law, clients have three (3) business days from the date of sale to cancel a product order under the "cooling-off period" for in-person sales. After this period, all product orders are final and will move into production.

Once the retouching process begins, orders are considered in production.

Following retouching and final client approval, artwork is sent to our professional partners for printing and assembly. Due to the personalized nature of these products, no refunds or exchanges are offered once any stage of production has begun, including retouching.

There are no refunds or exchanges offered for digital files, regardless of whether or not the client has downloaded them. By completing an in-person image selection and confirming the final order, the client agrees that image selection was made voluntarily and with full consent.

If, after delivery, the client wishes to obtain different or additional images to those already delivered, those may be purchased at the current a la carte or collection rates.

Changes to artwork after client approval may not be possible. The studio will make a good faith attempt to stop production; however, once an order has been submitted to production partners, the studio has no control over process or timeline.


7. Product Quality & Satisfaction

Tina Caron Portraits & Fine Art is committed to delivering heirloom-quality artwork and professional-grade printed products. We stand behind the

craftsmanship and quality of all tangible goods produced through the studio.

If a product arrives with a manufacturing defect, is damaged in transit, or exhibits clear flaws in materials or workmanship, the studio will work with the client to correct the issue promptly.

To ensure resolution:

Clients must inspect all products upon delivery or installation and report any concerns within three (3) business days. Issues reported beyond this window may not be eligible for replacement.

Please note:

Color, tone, brightness, and contrast may vary across different devices and print labs. These differences are not considered defects. The studio utilizes professionally color-calibrated monitors and industry-standard professional printing equipment to ensure accurate color reproduction and print quality for all artwork produced through the studio. The studio cannot predict or control variations that occur when images are viewed on non-calibrated devices or printed through third-party labs. As such, Tina Caron Portraits & Fine Art is not responsible for perceived color, tone, brightness, or contrast issues in any print not produced through the studio, or when viewed on electronic devices. Some online platforms may impact these parameters, affecting the perception of the image, and is out of our control.

8. Copyright & Usage

All images created by Tina Caron Portraits & Fine Art are protected under U.S. Copyright Law, and full copyright is retained by Tina Caron and Tina Caron Portraits & Fine Art.

Copyright is not transferred to the client under any circumstances unless a separate, written agreement is executed under a work-for-hire commercial contract and appropriate and agreeable compensation is negotiated at the time of booking.

Permissible Personal Use


Copyright Release and Print Release for Personal Use are not equivalent concepts; acquiring a Print Release does not in any way constitute permission to utilize digital and printed works by Tina Caron Portraits & Fine Art outside the personal usage rights listed below.

Clients are granted personal usage rights (aka Print Release) for purchased images. This includes:

ᐧ Use as profile images and on personal or professional social media feeds

ᐧ Printing for private display in a home or personal office

ᐧ Limited-size use on personal or small-business websites, business cards, brochures, company directories, professional listings and similar materials

Personal Usage rights and Print Release do not grant the right to alter the image, resell it, leverage in a transaction for profit, or use it in ways that suggest the client is the original creator.

Prohibited Uses Without Written Permission

ᐧ Submission to photography contests or competitions

ᐧ Use in AI training, stock image libraries, NFTs, or similar programs

ᐧ Creation of derivative works (e.g., paintings, drawings, composites) by third parties without written consent

ᐧ Use of images in any product for sale or promotional use with the intent of profit

ᐧ Transfer or sublicense of usage rights to another individual or entity

ᐧ Commercial use without a licensed agreement


Commercial use is defined as any use of an image that promotes or advertises a product or service for significant commercial gain, including:

ᐧ Billboards or large-scale advertising

ᐧ Product packaging or labeling

ᐧ Publication in or on books

ᐧ Television, film, or news media use


Permissible Professional Use includes:

Use of headshots or branding portraits in small-scale printed and digital marketing materials such as:

ᐧ Business cards

ᐧ Websites

ᐧ Flyers

ᐧ Brochures

A commercial license and usage fee may apply for any additional or extended use beyond the standard permissions granted. Any unauthorized creation of derivative works or commercial use will be considered a violation of copyright law and may be prosecuted to the fullest extent permitted.


9. Payment Disputes & Chargebacks

By booking with Tina Caron Portraits & Fine Art, the client agrees to the following terms regarding disputes and chargebacks:

Definition of Services Rendered

“Services rendered” refers to any activity performed by the studio in connection with the client’s booking. This includes, but is not limited to:

ᐧ In-person or virtual consultations (e.g., Style & Concept Consultations)

ᐧ Creative planning, design, or preparation for the session

ᐧ Communication and coordination relating to the session

ᐧ Time spent photographing during the booked session

ᐧ Image curation and preparation for presentation

ᐧ Retouching or design work on commissioned artwork

For Custom Portrait Sessions, Fine Art Commissions, and Dreamweaver Sessions services are considered rendered beginning with the first booked appointment (typically the Style & Concept Consultation).


For Headshot sessions, services begin at the time of the booked session.

Once these activities are initiated — in part or in whole — services are considered rendered, regardless of whether the client chooses to complete a purchase.

Dispute Resolution Requirement

Clients agree to make every reasonable effort to resolve any concerns or disputes privately with the studio before taking external action.

Due to the subjective nature of portrait photography and custom fine art:

Dissatisfaction with personal appearance in images (including but not limited to clothing, hair, makeup, posing, or styling) does not qualify as grounds for compensation or refund. By booking with the studio, the client affirms their understanding and acceptance of the studio’s artistic style, as presented in the portfolio, social media feeds, and marketing materials.

Chargebacks

Initiating a chargeback or dispute with your credit card agency or bank without first attempting to resolve the matter directly with the studio is a violation of these Terms & Conditions.

Chargebacks made after delivery of any portion of an order — including digital files, printed artwork, or other tangible goods — will be considered theft of goods. Chargebacks made after services have been rendered, but prior to or in lieu of final product delivery, will be considered theft of services.

In either case, the studio reserves the right to:
ᐧ Pursue legal action for recovery of funds, service value, and any associated fees or damages

ᐧ Report the incident to the credit card processor, financial institutions, and appropriate authorities

ᐧ Permanently ban the client from booking any future sessions with Tina Caron Portraits & Fine Art


Important: By receiving and accepting delivery of any portion of an order, whether physical or digital, the client affirms that payment for such goods is final and non-disputable.


10. Model Release

Unless otherwise specified in writing, clients grant permission for images to be used in the studio's portfolio, social media feeds, website, and digital and printed marketing materials. We respect your right to privacy; you may specify any or all of the sharing methods to be excluded, or to permit sharing without your name attached. Your privacy choices will be documented in a Model Release and records your consent for sharing or request for privacy.



11. Studio Policies


Safety:


The safety of all session participants, studio staff, and partners is a top priority. Clients and guests are expected to refrain from activity or behavior that could result in injury or harm to themselves or others, such as throwing objects, jumping on or off furniture, running, pushing, or shoving—even if done with playful intent.

The studio is a safe space for everyone, regardless of age, race, religion, size, political belief, gender, sexual orientation, marital status, physical differences or limitations, or any other protected class. We respect your values, opinions, and affiliations; we reserve the right to redirect any conversation or behavior that risks the perceived safety of the studio. Discrimination, bullying, or intimidation by clients toward studio staff and partners—and vice versa—will not be tolerated.


General Conduct:

Children under 18 must be accompanied by a parent or legal guardian. Please arrive on time and ready for your session. We reserve the right to refuse service to anyone acting inappropriately or disrespectfully.


Smoking, Substance Use, Abusive Behavior and Property Conduct:

Smoking and vaping are not permitted inside the studio or on the covered sidewalk at the storefront. Clients are expected to remain respectful of patrons of our neighboring businesses and ensure they are far enough from any storefront as to not disturb other businesses' foot traffic. Use of any illegal drugs or substances is grounds for immediate termination of the session and removal from the premises.

Abuse of any kind—verbal or physical—toward studio staff, partners, or any session participant will not be tolerated.

Theft of or willful damage to studio property or premises by any session participant or their guest, regardless of age, may result in forfeiture of spending credit as compensation for repair or replacement, and may result in legal prosecution. All remaining services will be canceled and the client will be banned from booking with the studio in the future.


Guest and Client Responsibility:

Clients agree to monitor the behavior of all session participants and to remain calm and respectful. Screaming, yelling and deliberately disruptive behavior are not appropriate. The studio understands that children can be challenging and will work patiently with babies, toddlers, and young children. While a specific age is not defined, school-aged children, teens, young adults and persons of all ages with full communication capabilities are expected to follow the direction of the studio staff and partners. Clients are welcome to invite a limited number of guests to their session to assist with personal needs, such as monitoring children or assisting with wardrobe. Guests are to refrain from giving posing or expression direction unless explicitly invited to assist by studio staff.

Cooperation:

Client agrees that the studio has been hired to produce an experience and final portraits that align with the agreed upon design and vision for the session. Client and all parties related to the session (participants and guests) therefore agree to cooperate with the studio staff by following direction for wardrobe, posing, placement, composition, expression. If the client refuses to cooperate, the studio reserves the right to terminate the session regardless of whether or not the final vision has been achieved.


Image Capture Restrictions:

Cell phone images or videos of sets, poses, or events are not permitted unless allowed under the guidance and limitations set by the studio during the session. Under no circumstances are "over the shoulder" photographs permitted. Sessions will not be paused for others to take images or video. Other photographers are not allowed at your session, including videographers, regardless of the type of equipment used without prior written approval from Tina Caron Portraits and Fine Art.


Deceptive Booking Policy:

The studio reserves the right to refuse to continue a session if it is determined the booking was made under deceptive circumstances. For example, if a session is booked as an on-location extended family portrait but is discovered upon arrival to be a wedding, or if a limited session such as a Signature Headshot is booked and the client arrives expecting a full family session.

Change in Scope of Session:

Changes in scope may incur additional fees to be paid with the final order. Changes in scope include but are not limited to:

ᐧ Number of persons

ᐧ Inclusion of children under 4 not previously disclosed at time of booking

ᐧ Undisclosed limitations that require special handling (e.g., wheelchair access, climate sensitivity, light sensitivity)

ᐧ Change in location or additional locations

ᐧ Expansion of vision resulting in extended session time or additional service providers (additional looks, wardrobe changes, hair and makeup changes)

ᐧ Extensive change in session goals

ᐧ Additional hair and makeup services requested after booking

ᐧ Locations requiring permits and fees



12. SMS and Text Messaging

Tina Caron Portraits & Fine Art may send you SMS messages for transactional reasons, such as appointment confirmations and reminders, orders, and other actions related to providing our services to you. We may from time to time send promotional messages for offers or services that may be of interest to you.

You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially or reply START, and we will resume sending SMS messages to you.

If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to 817-646-7226.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

13. Limitation of Liability

While all reasonable care will be taken, Tina Caron Portraits & Fine Art shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from delays, equipment failure, accidents, natural disasters, or other causes beyond our control.


In the unlikely event that the studio is unable to deliver images due to unforeseen circumstances, liability is limited to a refund of all payments received, including the booking retainer. No further liability shall be held for any claims or damages beyond the amount paid.

Clients acknowledge that portrait photography is a creative and subjective art form and agree that they are booking with an understanding of the studio’s artistic style and quality standards.


14. Agreement & Acknowledgment

By booking a session, attending any studio appointment, or purchasing services or products from Tina Caron Portraits & Fine Art, the client confirms they have read, understood, and agreed to all terms outlined in this agreement. These Terms & Conditions are subject to change at the studio's discretion; however, the version in effect at the time of booking shall govern that engagement.

Clients acknowledge that portrait photography is both creative and collaborative, and agree to participate respectfully and in alignment with the expectations outlined herein. Booking any session signifies agreement to all studio policies, procedures, and limitations outlined in this document.
